NeckCure — Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you", "your") and Easyfox Studio ("NeckCure", "we", "us", "our") governing your use of the NeckCure desktop application, website, and related services (together, the "Service"). By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old (or the age of digital consent in your country, if higher) to use the Service. By using the Service you represent that you meet this requirement.
2. The Service
NeckCure is a posture- and wellness-reminder application that uses your device's camera to detect posture locally on your device and remind you to sit upright. Some features are offered at no charge ("Free Tier"); others require a paid subscription ("NeckCure Pro" or "Pro").
3. Health Disclaimer
NeckCure is a general wellness and productivity tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Do not rely on the Service for any medical purpose. Consult a qualified healthcare professional regarding posture, pain, vision, or any health concern. You use the Service at your own risk.
4. Accounts and Sign-In
- You may sign in using Google Sign-In. You are responsible for maintaining the confidentiality of your account and for all activity under it.
- You agree to provide accurate information and to keep it current.
- We may suspend or terminate accounts that violate these Terms.
5. License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Service for your own personal, non-commercial use. We reserve all rights not expressly granted. The Service is licensed, not sold.
6. Restrictions
You agree not to, and not to permit anyone else to:
- copy, modify, distribute, sell, rent, sublicense, or resell the Service;
- reverse engineer, decompile, or disassemble the Service, except to the extent such restriction is prohibited by applicable law;
- circumvent, disable, or interfere with license validation, the device limit, or any security or access-control feature;
- share, transfer, or resell your account or subscription, or make it available to others.
7. Features and Changes to the Service
We may add, change, limit, suspend, or discontinue any feature or part of the Service — including both Free Tier features and specific Pro features — at any time. The Free Tier is provided "as is" and may be changed or withdrawn at any time without liability. If we permanently remove a material Pro feature that you are actively paying for, your sole remedy is to cancel your subscription (see Section 9) and, where required by applicable law, receive a pro-rated refund for the unused remainder of your current billing period. There is currently no free trial of Pro; paid features are available only through a paid subscription.
8. Devices and Device Limit
A single NeckCure account may have up to four (4) registered devices active at one time. If you sign in on a fifth device, the device that has been least recently used will be automatically signed out and will lose access to Pro features until you sign in on it again (subject to the device limit). You may view and remove your registered devices at any time through the in-app device manager. Sharing one account across more than your own devices, or with other people, is not permitted (see Section 6).
9. Subscriptions, Fees, and Automatic Renewal
- Pricing. The fees for NeckCure Pro, and the available billing periods (e.g. monthly or annual), are those displayed at the point of purchase on our website or checkout page at the time you subscribe. Prices may change; any change applies to future billing periods, not the current one. Promotional prices, discounts, and offers are limited-time and may be changed or withdrawn at any time; the price that applies to you is the one displayed at the point of purchase when you subscribe.
- Automatic renewal. Unless you cancel, your subscription automatically renews at the end of each billing period for another period of the same length, at the then-current price, and your payment method will be charged. If a renewal price will be higher than the amount you last paid, we (or Paddle on our behalf) will give you advance notice as required by applicable law before the increase takes effect, and you may cancel before renewal if you do not agree.
- Cancellation. You may cancel at any time through the customer portal provided by our payment provider (see Section 10). Cancellation takes effect at the end of the current billing period; you retain Pro access until then.
- Consumer rights. Where auto-renewal, cancellation, or advance-notice rights are required by applicable law (including U.S. federal and state law), those rights apply and nothing here limits them.
10. Payments and Merchant of Record
Payments are processed by Paddle, which acts as our authorized reseller and Merchant of Record. Paddle handles the sale, payment, invoicing, applicable taxes, and subscription management on our behalf. Your purchase is also subject to Paddle's terms and privacy policy. Manage or cancel your subscription and update payment details through the customer portal Paddle provides.
11. Refunds
Refunds are governed by our Refund Policy and by the policies of Paddle. Except as required by law, fees are non-refundable.
12. Automatic Updates
The Service may automatically check for, download, and install updates, including updates required for continued operation, security, or license validation. You consent to these automatic updates.
13. Privacy and Camera Data
Your privacy is described in our Privacy Policy. In summary: NeckCure processes camera images locally on your device, in memory only, to detect posture. Camera images are not recorded, stored, transmitted, or used for facial recognition or identification, and are discarded immediately after processing.
14. Intellectual Property
The Service, including all software, content, trademarks, and logos, is owned by NeckCure or its licensors and is protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NECKCURE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, the license in Section 5 ends. Sections that by their nature should survive (e.g. 14–16, 18–19) will survive.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (e.g. in-app or by email). Your continued use after the changes take effect constitutes acceptance.
19. Governing Law and Disputes
These Terms are governed by the laws of Taiwan (the Republic of China), without regard to its conflict-of-laws rules. The competent courts of Taiwan will have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence provides otherwise.
20. Referral Program
From time to time we may offer a referral program that lets you invite others to NeckCure and that may grant promotional Pro access to you and/or the people you invite. Any such program is a promotional offer, not part of the paid Service you purchase, and the following apply:
- We control the program. The rewards, eligibility rules, reward amount and duration, the number of rewards, how a referral is counted, and when a reward is granted are those described on our website or in the app at the relevant time, and we may change, limit, suspend, or end the program, or change any reward, at any time without liability.
- Rewards are promotional. Referral rewards are free promotional Pro access. They have no cash value, are not a purchase, are non-transferable, and cannot be sold, combined with other offers except as we allow, or exchanged for money; they expire as stated, after which your account returns to the Free Tier and you will not be charged.
- Eligibility. You must have a valid account and follow the program rules. We may require, for example, that an invited person be new to Pro, that the inviter and the invited person be different people using different devices and accounts, and that a referral count only once the invited person genuinely uses the Service. We determine eligibility.
- No abuse. You may not game, manipulate, or abuse the program. Prohibited conduct includes, without limitation, referring yourself; creating, controlling, or using fake, duplicate, or multiple accounts; using the same device or identity across "different" accounts; bots, scripts, or automated redemption; spam; misrepresenting the Service; or any scheme designed to obtain rewards you are not genuinely entitled to.
- We may withhold or reverse rewards. Where we reasonably suspect fraud, abuse, or a breach of these Terms or the program rules, we may — at our sole discretion and without notice — withhold, delay, reduce, revoke, or reclaim any reward, disqualify any participant, void affected referrals, and suspend or terminate the accounts involved. Our determination is final.
- Taxes and law. You are responsible for any taxes on rewards. The program is void where prohibited and is offered only where, and to whom, we choose. Nothing in this Section limits any non-waivable rights you have under applicable consumer law.
